Five Injured in Alleged DUI Accident on Texas 16 in Kerrville, Texas


Kerrville, TX — Five people were injured when a man who was allegedly under the influence of alcohol crashed into a road crew charged with repaving a section of Texas 16 in Kerrville, Texas. The accident took place on Saturday, September 9, 2014.

Police say that Ricky Littrell crashed into a paving machine before hitting two workers with the Texas Department of Transportation and three employees of Ramming Paving. Littrell did not stop after the accident, but proceeded to his home less than a mile away where we was arrested by local police.

Police obtained a warrant to draw Littrell’s blood, which was done at Peterson Regional Medical Center. Police charged him with five counts of intoxication assault and five counts of failing to stop and render aid.

Two of the five injured were taken to University Hospital in San Antonio. The other three were treated and released.

Commentary

Of course, if the driver in this accident was drunk at the time, then he needs to bear responsibility for what he’s done. However, there is the possibility that the driver was out at a bar or similar establishment and was being served alcohol when he should have been cut off. If authorities find that the driver was out drinking, was visibly intoxicated, and was being served anyway, then it’s possible that the bar could be found partially liable in the accident. This is a part of Texas’ dram shop laws, which are meant to regulate the safe sale of alcohol in the state. The point of these laws isn’t to take responsibility away from those who commit DUI offenses, but to hold everyone involved responsible. If the bar were still serving someone who was visibly drunk, and then that person goes out and gets into a wreck, then they’ve played a role in the accident, and should also be held responsible.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
