MARSHALL, MI — One man was hospitalized in an accident involving a tractor-trailer that happened in Marshall, Michigan on Tuesday, September 9th, 2014, according to the news article released by WLNS.
One man was seriously hurt when he was struck by a tractor-trailer while he was walking along or trying to cross the street at the intersection of Michigan Avenue and Cherry Street around 4:00 Tuesday afternoon, according to representatives from the Michigan State Police.
The victim was taken by helicopter to a nearby hospital where he was being treated for his injuries. An update on his condition was immediately unavailable.
The investigation is currently ongoing at this time.

A great deal of the fault in this accident is going to be decided based on where the victim was standing when they were hit by the truck. Pedestrian accidents can be difficult to argue from the standpoint of the victim. Unless the victim was standing on the emergency shoulder lane, in a marked and protected crosswalk, in a parking lot, or in a designated pedestrian lane or sidewalk. If this is the case in this accident, then the trucking company behind the tractor-trailer and driver could be held liable for the accident.
