Commentary
Accidents like this aren’t too uncommon. Shifting loads are one of the many ongoing safety concerns with commercial vehicle. And unfortunately, as wee see, these sorts of accidents can have consequences not only for tractor-trailer drivers, but for others out on the road as well. It’s difficult to imagine a scenario in which the trucking company wouldn’t be held liable for this accident. It’s always possible that the truck was loaded by a third party. In that case, the third party could also be held liable. In all likelihood, however, that’s not the case. Judging purely off of past experience, the trucking company will need to find a way to make this right with the victim. Luckily for all concerned, this wasn’t nearly as bad as it could have been.
