Fall River, MA — One man was sent to the hospital after a dump truck rolled over, crushing half of his car in Fall River, Massachusetts, on Wednesday, September 3, 2014. The accident took place on Route 24, around 11:45 in the morning.
Shawn Medeiros was driving along when a dump truck hauling used auto parts and being driven by Pierre Paul rolled over, losing its rear axle and landing on Medeiros’ vehicle.
Police say that Medeiros barely missed being hit himself, and that he’s lucky to be alive. He was taken to a local hospital and is listed in good condition.
The accident is still being investigated. At this point, police aren’t sure if mechanical failure or driver error is to blame.

From what’s been reported, it seems as if the dump truck is at fault for the accident, although the reason is still unclear. In any case, the trucking company is going to be liable for the injuries sustained by the victim. They should be held responsible. That’s just common sense. But there’s also the driver of the truck to consider. If the accident was caused by driver error, the company will have an insurance policy he’ll be covered under. That’s called workers’ comp. If the accident was a result of a mechanical failure, then it’s possible that the manufacturer would be held liable, both for the victim and the truck driver. Authorities are going to have to complete their investigation before anyone can know for sure.
