Commentary
Of course, the authorities will need to complete their investigation of the accident before anyone can know for sure, but it’s possible that the reason the truck overturned was because there was a problem with the way it was loaded. If cargo is ever improperly loaded and it shifts while the truck is out on the road, it can be very easy for a driver to lose control. If that’s the case, it’s possible the driver would have a claim, assuming the truck was loaded by a third party. If the driver himself or someone else from his company helped to load the truck, then this looks like a typical workers’ comp claim, that is to say, the employer would have insurance that would cover the driver’s injuries.
