Mechanicsville, MD — A man was killed in an accident with a dump truck in Mechanicsville, Maryland, on Saturday, August 30, 2014. The accident took place on Route 5, around 6:15 in the evening.
Jose Fuentes has been identified as the man who was struck by a dump truck. According to police, the dump truck had turned onto Route 5 from Thompsons Corner Road when Fuentes, riding a motorcycle, collided with its rear. He was ejected from his vehicle and pronounced dead at the scene.
Police say that the dump truck, driven by Robert Dade, failed to yield the right of way. However, speed and alcohol on Fuentes’ part also contributed to the crash.
The crash is still being investigated by local authorities.

Here we have an accident in which it appears that both drivers played a roll. Police say that the victim was speeding and may have been drinking. However, they say that the driver of the dump truck failed to yield the right of way. What a court may do in case like this is look at both sides and try to figure out exactly how much each party contributed to the accident. Failing to yield the right of way shows a lack of awareness on the part of the dump truck driver, and it can be argued that, had he yielded to the victim, the accident would not have occurred.
