Brent Gooden, Frederick Gooden, Diaz Fielder Killed in 18-Wheeler Accident on Highway 15 in Newton, Mississippi

Newton, MS — The investigation into the deaths of three people in Newton, Mississippi, has only uncovered a few details so far. The three were killed when they disregarded a stop sign and drove in front of an 18-wheeler on Monday, August 25, 2014. The accident took place on Highway 15, at the intersection with Martin Luther King Jr. Drive.

The three victims were identified as Brent Gooden and Frederick Gooden, brothers from Hickory, Mississippi, and Diaz Fielder, of Newton. Police Chief Harvey Curry, who was present at the time of the accident witnessed a vehicle pull into the path of the 18-wheeler and saw the truck clip its driver’s side. All three inside the car were declared dead at the scene. Curry has said that the accident is under investigation, with an accident reconstruction team having been called in.

No information on the truck driver was given.

Commentary

One aspect of accidents like this that unfortunately is often overlooked are the passengers in a vehicle who are injured or killed because of a decision the driver made. Just because these individuals are in the same vehicle as the driver doesn’t mean that they’re also guilty of his actions, or have their rights thrown out the window. In a case like this, the driver would be liable for the injuries sustained by his passengers. Likewise, if the driver of the truck is found to have done anything wrong, then he could potentially be found partially liable for the accident, and the families of those inside the car would have a claim against him.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
