Commentary:
You may assume that any kind of alcohol related accident in the State of Texas is handled no differently than a run-of-the-mill fender bender accident, but you’d be very wrong. Texas lawmakers found it necessary to arm people with the ability to hold licensed liquor sellers and servers such as bars, nightclubs, restaurants, and liquor stores – responsible for accidents that happen when they fail to serve and sell within legal parameters. What does this mean? If a customer walks into a bar who is already visibly intoxicated, and they are served anyways, the bar can be held liable for accidents their customer caused. Similarly, if a sober person walks into a bar, and is served beyond the .08 blood alcohol limit, the bar can also be held liable for the damages of an accident caused by their irresponsible service.
