Victoria Potter, Terry Peterson Killed in Dump Truck Accident in Volusia County, Florida


Volusia County, FL — Two people were killed in an accident with a dump truck in Volusia County, Florida, on Thursday, August 14, 2014. The accident took place on State Road 40.

Reports say that a dump truck driven by James Searls was driving along 40 when he crossed the center lane of the road and collided with a Ford Explorer being driven by Victoria Potter.

Both Potter and Terry Peterson, a 10-week old infant, were killed in the accident. Searls was seriously injured and taken to a local hospital.

The investigation into the accident continues.

Commentary

The important thing to remember about accidents like this is that trucking companies have a lot of experience with them while the typical motorist doesn’t. If your typical driver has ever been in an accident, there’s a good chance it wasn’t with a commercial vehicle.

Because commercial vehicles are required to carry a larger amount of insurance, there’s a lot on the line if the company is found liable. Because of that, a company will sometimes find itself defending very bad cases, all in an effort to protect their bottom line. It’s something they’re very good at. I’ve seen companies who have had their own accident reconstructionists on the scene before police arrived.

The long and short of it is, accidents like this can are going to be very unfamiliar waters for the majority of people out there. It’s always going to be a good idea for those involved to consult with someone who has had experience with them in the past, and who will be looking out for your best interests.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles.
