HARMONY TOWNSHIP, OH — A collision between two tractor-trailers sent one truck driver to the hospital in Harmony Township, Ohio on Tuesday, July 22nd, 2014, according to the news report from WDTN.
Police believe that Dempsey Parker was hurt when the tractor-trailer he was sleeping in was struck by another tractor-trailer while driving on Route 40 just before 10:00 Tuesday morning.
Scene of the Accident
Dempsey Parker was pinned in the vehicle after the crash and was taken by paramedics to Miami Valley Hospital where an update on his condition was not currently available.
The driver of the other tractor-trailer was identified as Gurvinder Bajwa, who was immediately unhurt after the accident.
The Ohio State Police was assisting the Columbus Fire Department with the crash investigation.
Commentary:
In this accident there is a potential legal argument for both trucks. On one side of the coin, we have a potentially illegally parked tractor-trailer in the emergency lane of a highway while the driver grabbed some shut-eye in the back of the truck. If this truck was parked illegally, there could be some liability here. On the other hand, if the rear tractor-trailer swerved off the road and struck a stationary vehicle in the emergency lane, there is also potential fault on his shoulders. It all depends on a number of factors, but this is one of those accidents where I believe a second look is warranted.
