Kimberly Barnes and Amanda Garza Injured After Car Wreck in Caldwell, TX


Local news sources in Caldwell TX stated that 45-year old Kimberly Barnes and 35-year old Amanda Garza were injured after a single-vehicle accident that happened on August 19 2012. Police in Caldwell said that Barnes was driving along County Road 377 near County Road 328 when she lost control and left the roadway striking a tree and overturning.

Barnes and her passenger Garza were taken to local hospitals for their injuries. A third passenger an unnamed male was also taken to the hospital. Garza was transported via airlift due her being pinned in the car reports said. Police also reported that none in the accident were wearing seat belts

Commentary

Causation is an integral part of negligence lawsuits.  Cases like this are always interesting because on the surface of the story there is no apparent reason why someone would lose control of their vehicle; it leaves open a whole host of possible causes of how the accident could have happened. 

This is also why at the start of a case the initial investigation is very important. Witness must be interviewed while their memories are still fresh and measurements of the accident scene should be taken in order to create a re-creation of what actually happened.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
