Commentary
Are pedestrians supposed to go walking out on the highway, in the middle of oncoming traffic? Well, no, of course not, but there are a few things we need to consider here. One, the victim had just been in a wreck, so it’s possible he was discombobulated and not thinking straight. Two, even though a pedestrian may be in the wrong in this case, that doesn’t give a driver free reign to smash into them. Drivers still have a duty to avoid accidents where at all possible. If the driver of the 18-wheeler could have avoided the accident, he should have. Could he have? Well, we don’t know. The police will have to complete their investigation before a liable party can be named.
