LUBBOCK, TX — A two-vehicle accident left an 8-year-old boy dead in Lubbock, Texas on Friday, July 4th, 2014, according to the report from Lubbock Online.
Authorities in charge of the crash think that 8-year-old Mark Castro was killed when the vehicle in which he was a passenger was struck by an SUV that had suffered a breakdown while on Spur 327 on Friday night around 10:15.

Paramedics rushed Mark Castro to Covenant Women’s and Children’s ER where he died a short time later.
The driver of the vehicle was identified as Roberta Camacho, who was taken by EMS to a nearby hospital with unspecified injuries.
The Lubbock Police Department is handling the investigation at this time.

This is a situation where the fault is really going to depend heavily on the placement of the vehicles at the time of the accident. If the vehicle had broken down, and had been limped into the shoulder of the road where it was struck, the driver of the vehicle could be faulted for the crash. On the other hand, if the vehicle had broken down and stopped dead in the middle of traffic, where the accident occurred, then both the driver of the broken down car and the driver of the other vehicle could both bear some of the liability, which could come down to a system of modified comparative fault.
