MONTGOMERY COUNTY, TX — A two-vehicle accident claimed the life of a 19-year-old Texas A&M Corps of Cadet member in Montgomery County, Texas on Thursday, July 3rd, 2014 according to the release from KBTX.
Texas Department of Public Safety says that they believe 19-year-old Thomas Bratcher was killed when police say he tried to pass in a no-pass zone and collided with another vehicle while driving on Gosling Road on Thursday afternoon.
Scene of the Accident
Thomas Bratcher was trapped in the Ford Mustang he was driving and was pronounced dead on the scene. The driver of the other vehicle was taken to a nearby hospital with unspecified injuries.
The investigation into the crash is being conducted by representatives from the Montgomery Police Department.
Commentary:
In the State of Texas, lawmakers decided on a system of modified comparative fault in order to dole responsibility out in accidents where the fault does not fall in a black and white 100% fault, 100% free-of-fault ruling. In these situations, a judge or jury does their best to mete out responsibility for the accident based on the evidence presented to them. From there, fault is doled out based on a sliding percentage scale representative of the overall cost of the accident.
