UPDATE: Christopher Newton Killed, Two Injured in Car Accident on Spur 577 in Kaufman County, Texas

KAUFMAN COUNTY, TX — A two-vehicle accident resulted in the death of one driver in Kaufman County, Texas on Sunday, June 22nd, 2014, according to the report from In Forney.

Police say that Christopher Newton was killed and another two were injured when a Chevy Tahoe and a pickup truck collided head-on while driving through the intersection of Spur 557 and Highway 80 around 2:00 Sunday morning.

Scene of the Accident

Newton was killed in the crash, while both Matthew Bagley and Holli Penn were taken to area hospitals after the accident.

The investigation into the accident is currently ongoing.

Commentary:

Even though it is mentioned nowhere in the news article, the time of the accident, the fact pattern, and the day of the week all point toward one thing in my mind. If alcohol is confirmed to be a factor in this crash, there is a very good chance that the driver had recently left a bar at around last-call, which is 2:00 a.m. in the State of Texas. If a bar over served the driver, or failed in their duty to cut them off or outright refuse service in the first place, the bar could be liable for the accident the driver causes under Texas liquor liability laws. Bars will only see drunk drivers as a liability by holding bars liable for drunk drivers.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
