Commentary:
This is probably one of these accidents where its going to boil down something called negligent instrument. In situations like this, a person entrusts a person with a vehicle, or device while fully aware of their lack of license, or inability or incompetence and trust them with the car or device anyway. In this situation, the owner of the vehicle or the device could bear the liability in this crash to some degree.
