Delyn Mumma Killed in DUI Accident on FM 556 in Pittsburg, Texas


Pittsburg, TX — Police have arrested David Moreno-Rosales for the death of a woman he hit with his car on Sunday, June 8, 2014. The accident took place on Farm to Market Road 556, in Pittsburg, Texas.

According to reports, Moreno-Rosales was driving along 556 when he crossed into oncoming traffic and hit Mumma. In the car at the time were two of Mumma’s children, ages nine and six. Both were injured. One was sent to East Texas Medical Center, and the other was taken to Children’s Hospital in Dallas.

Moreno-Rosales is being charged with intoxication manslaughter with a vehicle and two counts of intoxication assault.

Commentary

This accident occurred around 10:45 at night, so it’s possible that Moreno-Rosales was drinking at a bar before the collision occurred. If that’s the case, it’s also possible that the man was intoxicated, and still being served. Texas dram shop laws allow for a bar to be held responsible if they don’t cut off someone who’s visibly intoxicated who then goes out and gets into an accident. There are those thinks that lets the person who actually did the drinking and driving off the hook. That couldn’t be further from the truth. They’re the one who made the bad decision, and they should be punished for it. Still, the bar played a role in the accident as well, and it wouldn’t be right for them to serve and serve and serve someone who’s already drunk, then wash their hands of the whole thing when that person goes out and gets into an accident.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
