Commentary:
There is one fact that was reported in the news that screams ‘dram shop’, and that is the fact that the crash transpired just half an hour after the 2:00 a.m. last call for alcohol in Texas bars. What significance does this hold? Plenty, the State of Texas has equipped its residents with means of holding bars, liquor stores, and other alcohol-centric businesses to a higher standard than anywhere else. In a third party claim, a bar can be found liable for the accidents of their customers when they fail to serve them responsibly. If the offending driver was served beyond the point of intoxication, the bar that fueled them could be responsible in some part.
