CLEVELAND, AR — The driver of an ATV is dead, and his passenger was injured in an accident in Cleveland, Arkansas on Thursday, June 12th, 2014, according to the news article released by The Arkansas State Police Blotter.
Police have said that they believe Kassidy Thompson was hurt when the ATV on which she was a passenger is believed to have hit a deer while driving on Cowford Road around 9:00 Thursday night.

Kassidy Thompson was injured and taken to a nearby hospital. The driver of the ATV was identified as Andrew Bottoms, who was killed in the accident.
The investigation is currently ongoing.
Commentary:
You may not know this, but each and every time you enter, or mount a vehicle as a passenger, you have entered an unspoken contract with the driver that ensures the driver will operate the vehicle in a manner that will not hurt you, or anybody else. If the driver in this accident was speeding, and could not avoid an obstacle in the road, there could be some liability there, but again, it would all depend on the course of the investigation, and how the facts finally materialize.
