UPDATE: Shane Sabala Injured in Car Accident in Galveston, Texas


GALVESTON, TX — One man was killed, and another was sent to the hospital following a major pedestrian accident that happened in Galveston, Texas on Sunday, June 8th, 2014, according to the news article from KLTV.

Authorities charged with leading the crash investigation have said that they have reason to believe Shane Sabala was seriously hurt when a pickup truck that crashed over Seawall Boulevard around 7:00 Sunday morning.

Paramedics rushed Shane Sabala to a nearby hospital where he remained in serious condition after the accident. Another pedestrian was identified in the accident as 62-year-old Raphael Flajole, who was pronounced dead after the accident.

The investigation into the crash is currently ongoing.

Commentary:

The simple fact that the driver of the pickup truck was charged would be enough for most people to call this a slam-dunk, but there is no such thing when people are talking about civil liability cases. What these individuals fail to realize is that the drivers charges could easily be dropped after even a cursory investigation finds that the steering column locked up or the brakes were faulty. In either of these scenarios, the truck manufacturer, not the driver would be liable for the accident. All it would take to tell is the right pair of eyes combing through the evidence to see where the fault really lies.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
