Commentary
From what news sources have explained the driver of the Cadillac is probably responsible for the accident. If police do happen to find that the driver was DUI at the time, then this would be a different story. Any way you look at the accident, the driver is probably liable for what’s happened. If she were drunk, and had been served alcohol at a bar where whoever was doing to serving saw that she was drunk and served her anyway, then the bar would also be liable. From what’s been described, it doesn’t seem as if that’s the case. Unfortunately, this just seems like a case in which the driver wasn’t paying as much attention as they should have been, and people were hurt because of it. Speaking from a legal perspective, this would be handled through the driver’s insurance policy.
