Dallas, TX — Three seniors with the Dallas Independent School District were injured when their vehicle hit a curb and the driver lost control on the way to graduation rehearsal in the 2600 block of West Illinois Avenue. The accident took place around 2:30 in the afternoon.
In all, three students were injured. Delvin Washington was taken to Methodist Dallas Medical Center in critical condition. Devin Harper and Kevin Ramos were also taken to the hospital and are reported to be in fair condition.
The accident occurred when the vehicle was trying to pass an 18-wheeler on the road. The vehicle hit the curb, then spun out and hit a light pole.
No other injuries were reported.

Commentary
A driver has an obligation to create a safe environment for those riding along with him. Is that something the driver did in this case? It seems like reasonable men may disagree. What could change how this is handled is who owns the vehicle. If it’s a private vehicle, owned by one of the students, then they would be liable for the accident. If it was a vehicle belonging to the school district, then the district would be liable. In that case, recovering any sort of damages would be difficult, as sovereign immunity makes legal action against a municipal entity an iffy proposition. It isn’t impossible, by any means, but it is very complex.
