One Killed, One Injured in Box Truck Accident on Interstate 5 in Oceanside, California


OCEANSIDE, CA — One woman died, and a man was hospitalized in serious condition after a collision in Oceanside, California on Monday, June 2nd, 2014, according to a news article from Fox 5 San Diego.

Investigators have reason to believe that a 75-year-old woman was killed, and an as-of-yet unidentified 80-year-old man was seriously hurt when the van they were in collided with the rear of a stalled box truck while driving on Interstate 5 around 10:00 Monday morning.

The female passenger in the van was killed in the crash while the driver was taken by helicopter to nearby Scripps Memorial Hospital where an update on his condition was immediately available.

Officials from the California Highway Patrol is still handling the crash investigation.

Commentary:

This is one of those accidents where the driver of the box truck probably did everything right, but that doesn’t mean I don’t have questions about the accident. If the truck was suffering from some kind of mechanical problem, and if the truck was to some degree drivable, was it simply stopped in the middle of the road, or was there some attempt to clear the roadway of obstruction? If the truck was drivable and the vehicle did not pull out of the lanes of traffic, the trucking company could be liable for at least some portion of the accident if the news article is correct.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
