Seven Injured in DART Train Collision with Flatbed Trailer in Farmer’s Branch, TX


Farmer’s Branch, TX — A collision between a Dallas Area Rapid Transit train and a flatbed trailer injured seven people on Thursday, May 15, 2014. The accident took place at the Farmer’s Branch Station outside of Dallas, Texas, around three in the afternoon.

The rear of the trailer was too close to the tracks and the train crashed into it as it drove by. The train conductor broke both of his legs in the accident. Six others were taken to nearby hospitals for minor injuries.

Emergency workers had cleared the tracks by 10:00 that night.

Commentary

There are still a few things we don’t know about this accident that could have a big impact on how things move forward. Obviously the trailer shouldn’t have been parked where it was. So from that perspective, the trailer was in the wrong. But who does the trailer belong to? If it’s also owned by the city, it’s possible that there was some negligence on the part of whoever parked it that close to the tracks. However, if that’s the case, sovereign immunity is going to make it very difficult for those injured to recover any sort of damages. If the trailer is owned by a third party, that changes things quite a bit, and they would be liable for the accident, and for the injuries sustained by the victims.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
