UPDATE: Virginia Gilbert Killed in Car Accident in Summerland Key, Florida


SUMMERLAND, FL — A collision left one woman dead on Summerland Key, Florida on Sunday, May 25th, 2014, according to a report from WRCB-TV.

Police working with accident investigation teams have said that they have reason to think that 70-year-old Virginia Gilbert was killed when the vehicle she was driving was struck head-on by a vehicle that crossed into her lane from oncoming traffic while driving on Highway 1 just before 12:30 Sunday afternoon.

Virginia Gilbert was taken by EMS personnel to Fishermen’s Hospital where she died a short time later. Also injured in the collision was 35-year-old Rebecca Gilbert.

Officials from the Florida Highway Patrol are in charge of the crash investigation.

Commentary:

The State of Florida currently uses a system of determining fault called ‘comparative fault’ wherein one person asserts that the other owes them damages for an accident. Additionally, this makes accidents where victims and offending drivers are wholly one hundred percent at fault or innocent in an accident. Even if the news report indicates otherwise, there could still be a small percentage on the hands of the other driver. Either way, contributory negligence would determine this by having an impartial party such as a jury or judge distribute the fault after reviewing the evidence.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
