Commentary:
I’d be very curious to have a look at the roadway and the placement of the vehicles in this accident. The fact that the news report illustrates that the dump truck had struck a vehicle that had overturned tells us quite a bit about the situation. Truckers are trained to keep the distance between them and the vehicle in front of them wide enough so that if that lead vehicle were suddenly to stop dead in its tracks, the truck has enough room to either stop, or avoid the collision altogether. If the victims car had rolled, and the victim had exited the vehicle after the accident, that tells me there was a long enough span of time between the rollover accident and the victim being struck for the truck to have avoided the crash. If the trucker failed to do this for any reason, be it speeding, distracted driving, or a mechanical problem, the trucking company is probably going to bear the liability in this accident.
