Commentary:
Pedestrian accidents can be tough affairs for victims, and fault really all depends on where they were standing at the time of the accident. If the pedestrian was in a marked crosswalk, parking lot, or cordoned pedestrian area such as a bike lane or a sidewalk when they were hit, the driver will more than likely be faulted for the accident. Additionally, if the driver was turning, and failed to ensure the path he was turning into was clear at the time of the accident, the driver would also probably bear the liability.
