Commentary
News reports say that witnesses to the accident saw that the victim was driving very slowly whenever she crossed the road. The driver of the dump truck claims that he didn’t really have time to do anything besides hit his brakes. It’s possible that he actually had more time, but was so surprised at the sight of a car driving directly at him, lost a couple of seconds before the collision. If that was the case, then he would share some of he liability for the accident, because he didn’t do anything. We all have an obligation to avoid accidents whenever possible. Of course, I’m only speculating that things happened other than how the driver explained them. It’s also possible that he truly had no time to avoid the accident. If that’s the case, and it’s entirely possible that it is, then the victim would shoulder the liability for the accident alone.
