One Injured in Alleged Drunk Driving Accident with Tractor-Trailer in Sioux Falls, South Dakota


SIOUX FALLS, SD — One person was hurt in a collision between a sedan and a tractor-trailer that happened in Sioux Falls, South Dakota on Monday, May 19th, 2014, according to a news article from KSFY.

North Dakota State Police have said that they have reason to believe that one person was hurt when the white BMW in which they were a passenger collided with the side of a tractor-trailer while driving through the intersection of Cliff Avenue and Benson Road early Monday morning.

Scene of the Accident

One person in the BMW was taken to the hospital after the accident. The driver was arrested on drunk driving related offenses in connection with the accident.

Sioux Falls Police were handling the crash investigation and cleanup.

People may wonder what their standing may be after an accident as a passenger of a drunk driver. While depending on the state and the situation, any time you enter a vehicle as a passenger, believe it or not you have entered into a contract with the driver of that vehicle that ensures that driver will operate the vehicle in a safe and responsible fashion that will not harm you, themselves, or any other passenger in the car or driver on the road. If they violate this, by racing, driving recklessly, or operating the vehicle under the influence of drugs or alcohol, that contract has been violated, and the driver could be liable for the damages if the facts line up properly.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
