Commentary:
There is one fact reported in the news that is very interesting, and if true, may hold the manufacturer of the school bus responsible for the accident. It states that while in neutral, the bus will eventually roll. While there may be an explanation for this, it nonetheless invites the potential for a serious accident, as in this case. If this ‘feature’ was specifically designed into the makeup of the vehicle, the manufacturer could be liable for the accident.
However, if this accident was not the fault of the manufacturer, and the mechanic forgot to do something, the situation could come down to workers compensation. In all my years of researching these types of incidents, very rarely do I see a workers compensation claim actually adequately cover the employee. Additionally, employer sponsored doctors have a nasty habit of downplaying injury to the benefit of the victim, and the doctors employer. Regardless, this accident is surely worth a careful look.
