Commentary:
People may wonder should they ever find themselves in a situation where police, victims, and witnesses cannot determine fault in an accident. In these situations, where he-said-she-said seems to have a stranglehold on proceedings, a system called comparative fault or contributory negligence steps in to take the legwork from police and victims. In these cases, a jury or judge is provided with all the evidence, and both sides tell their stories. With this information, the subjective party does its best to determine fault with the accident. In these cases, independent investigations can go very, very far by adding information to the compiled evidence. This leads the verdict closes to the truth, and to the deserving parties.
