Commentary:
If this news report is to be believed, and the driver of the other vehicle did experience a brake failure, there could be a few ways this could go. If the brakes were working properly, and the person responsible for maintaining the car simply neglected their repair, the vehicle owner could be responsible for the accident. If the brakes worked fine, but were installed improperly, the shop that installed the parts could be liable for the accident if the job was recent. Lastly, if the brakes were installed to specification, but failed anyway, the manufacturer of the part that failed, or the builder of the car itself could be liable for the accident. It all depends on how the facts fall into place, but if I were a victim in this accident, I’d definitely be demanding a closer look.
