Commentary:
I’ve told people before, and I’ll say it again, just because a driver is ticketed after an accident does not mean that the case is by default open-and-shut. A traffic citation after a collision is by no means a smoking gun. While it cannot harm a case, a citation can be easily dismissed at a later date. For the driver of the offending vehicle to take responsibility for the accident, there may be a need to investigate the crash further and compile evidence. If the evidence points to the offending driver, then a claim can be made, and a jury can be provided with evidence so they can make a decision as to who is responsible for the accident.
