In accidents like these, it’s important to look at the amount of time a driver has to make decisions. Reports I’ve read about this accident say that the bus driver who hit the victim was trying to avoid hitting a bus in front of it. We’ve all seen school buses out on the road or dropping kids off in our neighborhood. We know how they move and typically how fast they drive. Is it very likely that the bus in this case slammed on it’s breaks and the driver of the second bus was forced to swerve out of the way? Probably not. It’s much more likely that the driver of the second bus wasn’t paying attention or was following too closely and was forced to swerve to avoid the collision.

In any case, it’s going to be extremely difficult for the victim to recover any sort of damages. The school district, and by extension the bus, belongs to a municipal entity, and bringing any sort of legal action against a municipal entity isn’t easy. Hopefully, as the bus driver is clearly at fault, the school district will step up and makes things right.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
