Commentary:
The fact that alcohol is mentioned in the article brings up an interesting point. While for the most part we associate drunk accidents with vehicles, and drivers that have come from a bar, these types of claims also apply to pedestrians. If the article is accurate, and the pedestrian is found to have been drinking, it is a safe bet to say he may have been over-served. If he was already drunk when he walked into a bar and was served anyways, or was served alcohol from sobriety to the point of intoxication, the bar, restaurant, or nightclub where he was drinking could be held responsible for the accident for their failure to serve alcohol in a safe and responsible fashion.
