UPDATE: Brandy Purkey Killed in Car Accident in Port Arthur, Texas


PORT ARTHUR, TX — One person has died after a pedestrian crash that happened in Port Arthur, Texas on Wednesday, April 7th, 2014, according to the Beaumont Enterprise.

Police believe Brandy Purkey was killed when he was struck by a dodge van when he was walking along or trying to cross Highway 73 around 2:30 in the morning.

It is not immediately clear if Brandy Purkey was pronounced dead at the scene, or if they were taken by EMS personnel to a nearby hospital where he died a short time later.

The investigation into the crash is being handled by officials from the Bridge City Police Department.

Commentary:

Depending on how these facts shape up, the pedestrian could be at fault for this accident. You may assume that “pedestrian’s always have the right of way”, which is not only factually incorrect, but is dangerous information to arm people with. Unless a pedestrian finds themselves in a parking lot, or marked and designated crosswalk, they do not have the right-of-way. However, if a driver sees the person in the road from a great distance off, and fails to avoid hitting them, the driver would surely be at fault for failure to take evasive action.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
