Commentary:
In states like California, there is a desperate need for comprehensive liquor liability laws, and accidents like this only serve to highlight that need. What are liquor liability laws? In the State of Texas, if I wish to open a bar, I must first enter into a contract with the state that allws me to serve alcohol, in exchange for the promise that I will do so safely and responsibly. If a person becomes grossly intoxicated at my bar, this means I have broken my contract with the state, and am potentially liable for any accident he may cause, so long as alcohol is the primary cause of the accident. This allows both bars and drunk drivers to be punished in the event of an accident, which is one of the ways we can begin to taper off the alarming drunk driving statistics.
