One Injured in Alleged Drunk Driving Accident in Shawnee County, Kansas


SHAWNEE COUNTY, TX — One person was rushed to the hospital after a head-on collision that took place in Shawnee County, Kansas on Thursday, May 1st, 2014, according to a news report from WIBW.

Police have said that they have reason to believe one person was hurt when the vehicle they were driving was struck head-on by a car that drifted over the median and into their path while driving on Highway 75 around 1:00 in the morning on Thursday.

One person was taken to the hospital for the treatment of their injuries. The driver of the offending vehicle was identified in the report as 43-year-old Angel Rivera, who currently faces drunk driving related charges in connection with the accident.

Representatives from the Topeka Police Department were assisting with the crash.

Commentary:

Dram shop laws are something many are unfamiliar with, but may pertain to this case. In the legal profession, bars, restaurants and liquor stores are all considered ‘dram shops’, and dram shop laws simply hold these establishments to a standard that hopefully cuts down on the number of drunk drivers out on the road, while at the same time opening up the doors to punish bars who serve irresponsibly. What do I Mean when I say ‘serve irresponsibly’? When a customer stumbles into a bar with bloodshot eyes, slurred speech, who has clearly been drinking, the bar is forbidden from serving them more alcohol, because to do so would endanger both the customer, and the general public. If a bar is found to have served a driver too much, they could be liable right along side the driver they fueled.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.
