SOUTH FORT MYERS, FL — One person was killed in a collision with a box truck in South Fort Myers, Florida on Monday, April 28th, 2014, according to a report from FOX4-JRN.
Investigators think that Barrett Thompson was killed when the pickup truck he was driving collided with a box truck after authorities believe it ran a light at while driving on Arc Way.
Scene of the Accident
Paramedics arrived on scene and pronounced Barrett Thompson dead. The driver of the box truck sustained unspecified injuries in the accidnet.
Authorities are working to determine the cause of the accident at the time of writing.
Commentary:
There are some of you out there that believe people involved in accidents are either completely at fault, or have no fault at all, when almost no accident is this black and white. In the State of Texas, we use what is referred to as ‘comparative fault’ which places the burden of divvying fault into the hands of a jury, who does their best to fairly allocate responsibility by assigning fault in a percentage value of the total damages in an accident. This means while a driver may be 95% at fault for an accident, the party who is responsible for the last 5% is still held accountable for their share. This allows for all parties involved to get their fair shake.
