Commentary:
I’ve said from the beginning that the only way the drunk driving problem can be really addressed is when both bars and drunk drivers are punished right along side the alleged drunk driver. Luckily many states have what those in the legal profession call ‘liquor liability laws’, that open the bars that over-serve drunk drivers to liability in the event one of their customers gets in an alcohol-related accident. If there were a way to throw a bar in a jail cell right next to the driver, I’d be all for it, unfortunately no such thing is possible, and the only way to take a bar to task for the negligent service of alcohol is through a civil action.
