CHARLOTTE, NC — One driver is dead after a traffic accident that happened in Charlotte, North Carolina on Tuesday, April 1st, 2014, according to the news article from WBTV.

Police have said that they have reason to suspect 39-year-old Ramez Elding was killed when the vehicle they were driving was struck from the rear by a Ford Expedition SUV while driving near the intersection of Tryon Street and Tyvola Road around 8:30 Tuesday evening.

Scene of the Accident

Officials pronounced Ramez Eldin dead on the scene when they arrived. The driver of the Expedition was later identified in the report as Michael Perrella, who is currently facing drunk driving related offenses in connection with the accident.

The investigation is being handled by representatives from the North Carolina State Police.

Commentary:

Handling alcohol related accidents is by no means similar to regular car accidents, contrary to popular belief. Whenever an alcohol related accident happens in the State of Texas, there is at least some part of the accident investigation that is criminal in nature, because if the driver had come from a bar, the bar that served them may have not done so in accordance with the law. What does that mean? Well, in Texas, we are lucky enough to have a set of liquor liability laws that ensure bars, restaurants, and alcohol stores serve and distribute alcohol responsibly. What does this mean? It means that bars are forbidden from serving you to the point of gross intoxication, which is why you see bartenders cut people off after too many drinks. If the bartender failed to cut this person off, or served him alcohol despite the customer’s obvious intoxication, then the bar can be held accountable right along side the driver. Once the drunk drivers and the bars that fuel them are punished together can we seriously address the drunk driving problem in the country.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
