UPDATE: Roy Harris Injured in School Bus Accident in Sabine County, Texas


SABINE COUNTY, TX — One person was taken to the hospital after a collision in Sabine County, Texas on Thursday, April 24th, 2014, according to a news report from KTRE.

Representatives from the Texas Department of Transportation have said that they believe 18-year-old Roy Harris was hurt when the vehicle he was driving collided with the rear of a school bus while driving on Highway 21 around 7:30 Thursday morning.

Roy Harris was taken by EMS personnel to a nearby hospital with serious injuries. No students on the bus reported injury after the accident.

Officials hope to release the findings of their investigation at a later date.

Commentary:

People seem to confuse school buses and fire trucks with commercial vehicles, but the main difference in bringing civil action to a school bus is the fact that you are dealing with a state agency. Many states have what we in the legal industry call ‘damage caps’ that essentially install a ceiling on settlements for when a federal, state or local agency is found to be at fault for a wrongful death or injury. Additionally, many jurisdictions have strange statues on filing suit. Many require a notice to the city with a time limit that is quite unforgiving, and acts like a sort of shield, which is why time is always important with situations like this.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
