Commentary:
In an accident like this, people may wonder how fault would be determined if the police investigation came up as inconclusive. In the State of Texas, lawmakers understood how convoluted accident investigations can become, especially in chain reaction or pileup accidents when there are more than two vehicles involved. For the solution, legislators devised a ‘comparative fault’ regime that removes the legwork and the ‘he-said-she-said’ scenarios often dealt with in motor vehicle accidents. With comparative fault, a jury is given all the evidence that is deemed relevant and does their best to fairly allocate fault using a percentage value of the overall sum of the damages. This is why an independent investigation can make or break a case where liability is concerned.
