Commentary:
At first glance this accident may seem like it could be blamed on driver error, but we may not have all the information to make this kind of call from a cursory news report. People who see a single-vehicle accident are often quick to blame the driver, but is it really so bizarre to think that something within the vehicle caused the accident? We all know car parts wear down, break, and fail all the time. We hear of vehicle recalls all the time, the problem with recalls lies in the fact that several accidents of a similar nature have to happen before a manufacturer will take notice, and even then they still may not issue the recall for some time. If this accident is found to have been caused by a mechanical error, be it steering, brakes or accelerator problems, the manufacturer of the vehicle may be liable for the accident.
