FORT WORTH, TX — A pedestrian was killed in a traffic accident in Fort Worth, Texas on Sunday, April 20th, 2014, according to a news report released by the Fort Worth Star Telegram.
Officials have said that they have reason to believe 22-year-old Stephen Hernandez was killed when he was struck by a vehicle when he was walking along or trying to cross Highway 360 around 9:00 Sunday night.

Stephen Hernandez was pronounced dead at the scene by responding paramedics. No other injuries were detailed in the news report.
The investigation is being handled by officials from the Fort Worth Police Department.
Commentary:
Pedestrian accidents can be tough, because generally speaking, pedestrians don’t usually have the right of way, contrary to popular belief. In fact, unless you are in a parking lot, pedestrians rarely have the right of way. Of course, there are exceptions to the rule. If somebody is in the road and the driver has time to react or move, and doesn’t, the driver is clearly in the wrong. Having the right of way does not entitle you to hit a person with your car. Additionally, if the pedestrian was walking in the shoulder of the road, and was struck by a vehicle that bled out of their lane, the driver is more than likely at fault. Keep in mind that it all depends on the result of the final investigation, but the victims in pedestrian accidents have a long fight ahead.
