UPDATE: Barbara Malo Killed in Alleged Drunk Driving Accident in Klamath County, Oregon


KLAMATH COUNTY, OR — A woman is dead after a pedestrian accident that was reported in Klamath, Oregon on Sunday, April 20th, 2014, according to a release from The Herald and News.

Barbara Malo is thought to have been killed when she was struck by a vehicle when she was walking along or trying to cross Rosewood Lane around 7:15 on Sunday evening.

Despite an emergency response helicopter being called to the scene, 63-year-old Barbara Malo was pronounced dead on the scene before she could be taken to a nearby hospital.

The driver of the offending vehicle was identified in the report as 23-year-old Joseph Schuster, who currently faces drunk driving related charges in connection with the accident.

The investigation is currently ongoing.

Commentary:

Many people I talk to about any kind of alcohol related accident tends to be completely unaware of liquor liability laws, and what they possibly mean for the victims of alcohol related accidents. Liquor liability laws are installed by lawmakers that understand that bars have a hand in serving a mind-altering substance, and the role that bartenders and servers have with their ability and responsibility to cut off intoxicated patrons, or refuse already drunk individuals from ordering in the first place. Essentially, if a bar fails to serve alcohol in a responsible fashion, they could be held liable for any accident their customers cause. This is why it is always important to find out where an alleged drunk driver was driving before an accident.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
