Commentary:
A large number of people who come into my office after having experienced an accident like this have the assumption that just because the other driver was cited after the crash that the case is open-and-shut, when this simply isn’t the case. First of all, the citation may have nothing to do with what caused the accident. Second, the person has to be found guilty for the infraction. Keep in mind that it certainly doesn’t harm the case in any way, but fault still has to be established. With the burden of proof on the shoulders of the victims, conducting an independent investigation is always a good idea for the most complete picture of what transpired in an accident.
