GARVIN COUNTY, OK — A serious accident took the life of one man in Garvin, Oklahoma on Tuesday, April 15th, 2014, according to the news report from News 12 KXII.
Authorities believe 74-year-old Kern Pirkins was killed when the car in which he was a passenger was struck by a vehicle head-on as the car was making an attempt to pass another car while driving on Highway 77 Tuesday afternoon.

Kern Pickens was taken by EMS personnel in a helicopter to a nearby hospital where he succumbed to his injuries a number of hours after his arrival.
The investigation into the accident is being handled by officials from the Oklahoma State Police.

Any time there is difficulty determining fault in an accident, often times it comes down to what we in the legal industry call ‘comparative fault’, which helps take the guesswork out of liability off the shoulders of victims and police. When an accident boils down to comparative fault, a jury is presented the evidence, and does their best to divvy up responsibility to the best of their ability. What this means is; if an accidents damages total up to one thousand dollars, and one party is found to be liable for 30 percent of the crash, they would be expected to compensate the other party for three hundred dollars. Keep in mind it is nowhere near this simple, but for explanations sake this is how this accident may be divided.
