Commentary:
Many people who come into my office believe that just because the person that hit them with their car was ticketed after an accident, that the person is now responsible for the accident by default, and this is simply not the case. Texas uses what people in the legal profession call ‘comparative fault’ which essentially allows a jury to divvy up fault based on percentages. If a person causes an accident whose damages total up to $100 dollars, and is found to be 20% at fault for the accident, that person would be responsible for $20 in damages. Clearly, I’m oversimplifying things for the sake of explanation, but this is the general idea. The burden of proof rests on the victims in cases like this, and proving fault is not as easy as pointing to the person with the speeding ticket in their hand after an accident.
