Commentary:
Many people are unfamiliar with comparative fault, how it works, and how it may relate to them or the accident they’ve been through. Simply put, the State of Texas uses a system of ‘comparative fault’ where a jury will decide to what degree at fault either party is in an accident. This is done using a percentage-point system, meaning, if I am involved in an accident that causes one hundred thousand dollars in damages, and I am found eighty percent at fault for the accident, I am responsible for eighty thousand dollars of the accident. This is obviously an oversimplification, and things can become quite muddled with conflicting details, but this is a rough summary of how comparative fault works, and how it may apply to any accident in Texas.
