TEXARKANA, TX — A two-vehicle accident left one woman dead and sent other motorists to the hospital in Texarkana, Texas on Thursday, April 3rd, 2014, according to a news report from ArkLaTexas Homepage.

Police have said that there is reason to suspect 61-year-old Linda Yeager was killed when the car she was driving crossed unexpectedly into the lanes of oncoming traffic and collided head-on with a pickup truck at the intersection of Cowhorn Creek Road and Cowhorn Creek Loop around 5:30 Thursday evening.

Scene of the Accident

Linda Yeager was pronounced dead on the scene by emergency responders when they arrived. An unspecified number of people were taken to the hospital with unspecified injuries.

The investigation into the accident is being handled by officials from the Texas Department of Transportation.

Commentary:

Many people are unfamiliar with comparative fault, how it works, and how it may relate to them or the accident they’ve been through. Simply put, the State of Texas uses a system of ‘comparative fault’ where a jury will decide to what degree at fault either party is in an accident. This is done using a percentage-point system, meaning, if I am involved in an accident that causes one hundred thousand dollars in damages, and I am found eighty percent at fault for the accident, I am responsible for eighty thousand dollars of the accident. This is obviously an oversimplification, and things can become quite muddled with conflicting details, but this is a rough summary of how comparative fault works, and how it may apply to any accident in Texas.

I'm a former employee. I had brought up this exact scenario and suggested a maintenance procedure that would eliminate the possibility of this type injury. Obviously my warning went unheeded.

I was actually a couple cars back from this wreck, one of the first on the scene, and helped administer CPR on the victims. The truck driver was going way too fast, but it was actually his trailer that swung around and hit the suv, the semi-truck ended in the median.

A lot of people say smack about lawyers, but I want to say that I'm glad there is a way that people who are wronged by corporate neglect can get justice and force change. We are living in a world where corporations and govt care less than ever about common people, and I support your work. I hope I will never need your services.

Thank you for posting these accident articles on your site. At the company that I work for, e deal with monitoring construction activity and work around trenches and all sorts of construction equipment/vehicles. I sometimes wonder if construction companies have enough safety training to inform employees of how to protect themselves while on the job.
